Mediator
|
Mediators, also known as arbitrators, are professional counselors who assist multiple parties in resolving disputes and differences. Mediators are often also legal counselors, such as lawyers, familiar with the law, claims, and different obligations of each party. Sometimes, disputes arise between individuals, sometimes disputes arise between entities involving multiple persons or even corporations.
Mediators often specialize in one or more types of circumstances, such as divorce, and assist the two or more parties in a dispute come to an agreement which is acceptable to each party involved. Sometimes, especially in cases involving large sums of money, each party will bring its own legal counsel with it, who are familiar with the laws and obligations of their clients, and the mediator or arbitrator will primarily work with the legal counselors representing each party. In some cases mediation or arbitration cannot be reached, in which case the parties must then take their case to a legal court. But often, before mediation begins, parties will consent to make arbitration mutually binding, which means that each party agrees beforehand that whatever decisions the mediator comes to will be binding to all parties to follow and adhere to. His determination will become a binding contract for each party.
